By using The Family Service Association of Greater Elgin's Website ("Website"), you agree to be bound by these Terms of Use ("Agreement"), whether or not you register as a member of our Website ("Member").

If you wish to use the services offered here ("Service"), please read these Terms of Use carefully. If you object to anything in this Agreement, do not use the Website or the Service. The Terms of Use are subject to change by Family Service Association of Greater Elgin (FSA) at any time, effective upon posting on the Website, and your continued use of the Service after such posting constitutes acceptance of such changes.

1. Electronic Agreement & Consent

This Agreement is an electronic contract setting out the legally binding terms of your use of the Website and membership in the Service. By accessing the Website or becoming a Member, you consent to have this Agreement provided to you in electronic form. This Agreement includes FSA's Acceptable Use Policy for Content Posted on the Website, Privacy Policy, subscription policies, and any posted notices regarding the Website.

Withdrawing Your Consent: You have the right at any time to withdraw your consent to have this Agreement provided in electronic form. Should you choose to withdraw your consent, we will discontinue your username/email and password, terminating your right to use the Service. Withdrawal will take effect within a reasonable time after receipt of notice and will not affect the legal validity of agreements electronically agreed to prior to withdrawal.

Access & Retention: To access and retain this electronic Agreement, you must maintain access to the World Wide Web and all necessary hardware and software. Please print or save a copy of this document for your records.

2. Term and Account Termination

This Agreement remains in full force and effect while you use the Website or maintain a membership. You may terminate your membership at any time by sending an email notice to bmay@fsaelgin.org. FSA may terminate your account or access at any time in its sole discretion, without prior notice or required disclosure of reasons. All provisions that by their nature survive termination shall survive.

3. Non-Commercial Use by Members

The Website is for the personal use of individual members only and may not be used in connection with any commercial endeavors. Unauthorized or illegal use—including harvesting usernames or emails for unsolicited communications or framing the Website—will be investigated and subject to appropriate legal action.

4. Proprietary Rights & Content Ownership

FSA owns and retains all proprietary rights in the Website and Service, including copyrighted material, trademarks, and intellectual property. You may not copy, modify, publish, transmit, distribute, perform, display, or sell any proprietary information without explicit prior written permission.

5. Prohibited Activities

FSA reserves the right to investigate and terminate membership for misuse or unlawful behavior. Prohibited activities include, but are not limited to:

• Impersonating any person or entity.
• Stalking, harassing, or bringing harm to any individual.
• Expressing or implying that statements are endorsed by FSA without written consent.
• Using automated devices (robots, spiders, scrapers) to index or reproduce site content.
• Transmitting viruses, malware, or code designed to interrupt or damage functionality.
• Modifying, adapting, sublicensing, reverse engineering, or decompiling any part of the site.
• Framing or mirroring any portion of the Website without written authorization.

6. Disclaimers & Limitation of Liability

The Website and Service are provided on an "AS-IS" and "AS-AVAILABLE" basis. FSA expressly disclaims any warranty of fitness for a particular purpose or non-infringement. FSA does not guarantee specific results from site usage.

Except in jurisdictions where such provisions are restricted, FSA will not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, arising from your use of the Website or Service.

7. Copyright Infringement Claims (DMCA)

If you believe your copyrighted work has been infringed on our Website, please notify our Copyright Agent with a detailed written claim containing:

• Physical or electronic signature of the authorized copyright owner.
• Identification and description of the copyrighted work claimed to be infringed.
• Location of the material on the Website.
• Your contact information (address, phone number, email).
• A statement of good faith belief that the disputed use is unauthorized.
• A statement under penalty of perjury that the information provided is accurate.

8. Governing Law, Jurisdiction & Indemnity

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois. You expressly agree that exclusive jurisdiction and venue for any legal dispute arising out of or relating to this Agreement or Website usage shall reside in the state or federal courts located in Cook County or Kane County, Illinois.

You agree to indemnify and hold FSA, its subsidiaries, administrators, and partners harmless from any loss, liability, claim, or demand (including reasonable legal fees) arising from your breach of this Agreement or misuse of the Service.
